1. Introduction
These Terms and Conditions of Sale ("Terms") govern the use of the TrendStory platform, an AI-powered short-video generation SaaS service featuring anthropomorphic fruits in drama/reality-TV style content for TikTok, YouTube Shorts and Instagram Reels, accessible at TrendStory.io.
By registering or using TrendStory, you unreservedly accept these Terms. If you do not accept these Terms, you must not use our service.
Payments are managed by Whop Inc. (whop.com) as the Merchant of Record. Whop is responsible for billing, VAT collection and transaction processing. TrendStory, operated by TRENDSTORY LLC (a limited liability company organized under the laws of the State of Wyoming, United States — 30 N Gould St Ste R, Sheridan, WY 82801), provides the technical AI video generation service.
2. Eligibility
To use TrendStory, you must be at least 18 years old and have the legal capacity to enter into a binding contract. By registering, you represent and warrant that you meet these eligibility requirements.
3. Nature of the Service and Content Responsibility
TrendStory is a technical content creation assistance tool. The platform provides automated content generation technologies powered by artificial intelligence. TrendStory is neither a publisher nor a broadcaster of content. TrendStory does not control, moderate, validate or supervise content generated by its users.
You are solely and entirely responsible for the videos you generate, upload, publish and distribute on any platform (TikTok, YouTube, Instagram, or any other). You are responsible for ensuring that your content complies with applicable law, third-party rights and the terms of use of distribution platforms.
TrendStory shall under no circumstances be held liable, directly or indirectly, for the nature, tone, offensive, shocking, violent, controversial, defamatory, misleading or unlawful character of videos generated by users through the platform. This includes, without limitation, public reactions, controversies, reports, legal proceedings or any other consequence arising from the publication of such content.
By using TrendStory, you acknowledge that content generated by artificial intelligence may produce unexpected, inappropriate or controversial results, and that you assume full responsibility for verifying, validating and adapting such content before any publication.
4. Copyright and Intellectual Property
Videos generated by the TrendStory platform are the intellectual property of TrendStory. Your active subscription grants you a non-exclusive commercial use licence for the duration of your subscription.
Videos already published prior to the cancellation or expiry of your subscription may remain online without restriction. However, generating new content requires an active subscription.
You are not authorised to resell, sublicense or redistribute the platform or its underlying technologies. Any unauthorised reproduction or use of our content, logos or visual elements is strictly prohibited.
Copyright Infringement Notices (DMCA)
If you believe that content accessible through TrendStory infringes your copyright, you may send a notification compliant with the Digital Millennium Copyright Act (DMCA, 17 U.S.C. § 512) to support@trendstory.io, specifying: identification of the protected work, the location of the allegedly infringing content, your contact details, a good-faith statement, a statement of accuracy made under penalty of perjury, and your physical or electronic signature. TrendStory will promptly remove any duly notified infringing content and may terminate the accounts of repeat infringers.
5. Prohibited Uses
It is strictly prohibited to use TrendStory to:
- Create or distribute content that infringes the intellectual property rights of third parties.
- Defame, harass or damage the reputation of any natural or legal person.
- Publish or promote misinformation, fake news or misleading content.
- Engage in illegal activities or activities contrary to public order.
- Circumvent the platform's security or access mechanisms.
- Resell or transfer your access to the platform to third parties.
- Create or distribute violent, hateful, sexual, discriminatory content or content likely to disturb public order.
Any breach of these rules may result in the immediate suspension of your account without notice or refund. TrendStory declines all liability for any legal, financial or reputational consequences arising from the use of user-generated content.
6. Disclaimer of Warranties and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED — INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. TRENDSTORY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT GENERATED CONTENT WILL MEET YOUR EXPECTATIONS. This disclaimer applies to the fullest extent permitted by law; it does not deprive consumers of the mandatory statutory warranties of their country of residence.
To the fullest extent permitted by applicable law, TrendStory shall not be liable for:
- Content generated by users through the platform, including its viral, controversial, offensive or divisive nature, and all consequences related to its publication or distribution.
- Reactions, comments, reports, complaints or legal proceedings by third parties resulting from the publication of user-generated content.
- The removal, demonetisation, restriction or suspension of your content or accounts by third-party platforms (TikTok, YouTube, Instagram, etc.).
- Loss of revenue, data, reputation or business opportunities resulting from use of the service or distribution of generated content.
- Temporary service interruptions for maintenance, updates or technical reasons.
- Any indirect, consequential or special damages resulting from the use of or inability to use the service.
TrendStory's total liability, for any reason whatsoever, is limited to the amount paid by the user during the three months preceding the incident.
7. Indemnification
You agree to defend, indemnify and hold harmless TrendStory, its operator, partners and suppliers from any claim, liability, damage, cost or expense (including reasonable legal fees) arising from:
- Your use of the service and the content you generate, publish or distribute.
- Any controversy, dispute or reputational harm to third parties caused by your content.
- Your breach of these Terms or applicable law.
- Any third-party claim relating to videos you have generated or distributed.
8. Account and Subscription
TrendStory operates on a monthly subscription model that renews automatically on the anniversary date of your subscription and continues on a rolling monthly basis until you cancel it. The amount is charged each month by Whop Inc. as the Merchant of Record. Whop is the legal seller: it issues invoices, collects applicable VAT and manages transactions. TrendStory provides the technical service.
Annual billing: some plans (Pro, Ultra) also offer optional annual billing. In that case, the amount corresponding to 12 months is charged in a single payment by Whop Inc., but your credits continue to be granted every month, exactly as with a standard monthly subscription. An annual subscription renews automatically on its anniversary date for a further 12-month period, unless you cancel it. You may cancel an annual subscription at any time from the Settings page; cancellation takes effect at the end of the 12-month period already paid for. The Starter plan remains available on monthly billing only.
You are responsible for the security of your credentials (email address and password). Any unauthorised access must be reported immediately to support@trendstory.io.
No partial refund is provided for unused days within a subscription period.
9. Right of Withdrawal
In accordance with applicable consumer law (in particular Directive 2011/83/EU for the European Union and, for France, Article L221-28 of the French Consumer Code), the 14-day right of withdrawal does not apply to contracts for the supply of digital content not provided on a physical medium, the performance of which has begun with your prior and express consent and for which you have waived your right of withdrawal.
By subscribing or purchasing top-up credits, you expressly consent to the immediate performance of the service and acknowledge that you waive your right of withdrawal. This consent is collected at the time of purchase via the notice displayed below the payment button.
As payments are managed by Whop Inc. as the Merchant of Record, the right of withdrawal also applies in accordance with Whop's general terms available at whop.com.
10. Refunds and Cancellations
Subscriptions and top-up credits: refund requests relating to payment must be addressed to Whop Inc. (Merchant of Record) via their platform whop.com, in accordance with their terms and conditions.
Credits and technical service: TrendStory may grant credit allowances in the event of a proven technical malfunction of the platform preventing any use of the service. Contact support@trendstory.io.
Cancellation of your subscription is possible at any time and takes effect at the end of the current period.
11. Credit System
TrendStory uses a credit system to access generation features:
- Plan credits: included in your monthly subscription. They are reset (cleared and re-credited) at every renewal cycle and never roll over — any unused plan credit balance at the end of a cycle is lost.
- Top-up credits: purchased separately via one-time packs. They are kept with no expiration date: they survive your subscription's monthly renewal and the plan credits reset, and remain usable for as long as your account exists.
Plan credits are consumed first, before top-up credits. If your subscription is cancelled or expires, your top-up credit balance remains yours and usable for features that do not require an active subscription. Credits of any type are neither refundable nor transferable to another account.
12. Termination of Service
TrendStory reserves the right to suspend or terminate your access to the platform without notice in the event of a breach of these Terms, misuse of the service or fraudulent behaviour.
TrendStory may also decide to discontinue the service for any commercial or technical reason, with reasonable notice except in cases of emergency. In such a case, a pro-rata refund may be considered.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. In the event of a dispute relating to their interpretation or performance, the parties undertake first to seek an amicable resolution. Failing an amicable agreement, the dispute shall be submitted to the exclusive jurisdiction of the state and federal courts located in the State of Wyoming. To the fullest extent permitted by applicable law, disputes shall be brought on an individual basis only, and not as part of any class or representative action.
If you are a consumer residing in the European Union, the United Kingdom or any country whose law grants you mandatory protections: nothing in these Terms deprives you of the mandatory protections afforded by the law of your country of habitual residence, and you retain the right to bring any dispute before the competent courts of your country of residence.
14. Amendments to the Terms
TrendStory reserves the right to amend these Terms at any time. Amendments take effect upon publication on the site. In the event of a material change, you will be notified by email. Continued use of the service after notification constitutes acceptance of the new terms.
